(2)Every walkable entrance from the surface to the working belowground shall be provided with a substantial gate which shall be kept closed and locked when there are no persons belowground:Provided that where such entrance is not used as a means of ingress or egress in or out of the mine, it shall be permanently closed so as effectively to prevent persons from entering therein.
