                                           O R D E R


Facts:

1. The  appellant   filed    an   RTI   application  on  5­2­2012  requesting  for  a  copy   of  personal details of certain employees of the Railways.  The CPIO responded on 26­2­2013  denying information to the appellant   under section 8(1)(j) of the RTI Act on ground of  personal information.  The appellant filed an appeal before the first appellate authority on  26­3­2013.  The FAA's response is not on record.   The appellant filed a second appeal with  the Commission on 21­5­2013.

Hearing:

2. The appellant was heard through video­conferencing. 

3. The appellant referred to his RTI application of 5­2­2012 and stated that in the  application he had requested for photocopies of the following: (1) certified copy of a sick  memo. of a certain employee; (2) details of railway doctor who treated the said employee;  (3) whether regular payment has been made from 1­1­2007 to 29­1­2008; (4) balance of  LAP and LHAP on 1­1­2007 and Leave A/c; (5) photocopy of entire service book and pay  fixation chart; (6) about appointment in the pay scale of Rs. 9300­34800 with grade pay of  Rs. 4600/­; and (7) photocopy of certain service books, leave accounts and pay fixation  chart. The appellant stated that the said information was denied to the appellant.

4. The PIO responded on 26­2­2013 denying the information to the appellant on  ground of personal information under section 8(1)(j) of the RTI Act which is exempted  from disclosure clauses. 

5. The action taken by the respondent is in conformity with the RTI Act.

Decision:

6. Decision of the respondent is upheld.

Appeal is disposed of. Copy of this order be given free of cost to the parties.
