Jayanta Kumar Biswas, J : The eight petitioners in this CRAN dated August 1, 2013 are seeking relaxation of a condition mentioned in an order of this court dated March 26, 2013 in CRM No.4370 of 2013 granting them bail. The condition restrains them from entering the Domkol Sub-division jurisdiction except for attending court proceedings.
Advocate for the petitioners has submitted that the petitioners, cultivators, unable to enter their respective places of residence are facing lots of hardship. Advocate for the State has left the matter to our discretion.
After considering all aspects, we are of the view that the condition should be relaxed. As noted before the bail order was passed as back as March 26, 2013. The petitioners are accused of offences under ss.147/ 148/149/324/302 IPC and ss.25/27 Arms Act and s.9B Explosives Act.
For these reasons, we allow the CRAN and order as follows. The restrictive condition is withdrawn. The petitioners are permitted to enter the Domkol Sub-division jurisdiction. They shall, however, report to the officer in charge of Jalangi police station every alternate day. Certified xerox.
