This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No. 126 of 2025 registered at Police Station - Amanaka, District Raipur (C.G.) for the offences punishable 2 under Sections 318(1) and 336(3) of the BNS, 2023.

Prosecution case, in brief, is that on 20.04.2025, the Assistant District Excise Officer received an information that owner of the Dhaba is selling liquor illegally and thereafter a raid being conducted at BH Dhaba situated at village Tendua and level/cover (Dhakkan) hologram was seized and the same was seized from the owner of the Dhaba i.e. Sankat Mochan Singh @ Shankar Singh and on the basis of his information, the police conducted the raid in the shop of Ganesh Chourasiya who is running the Printer's shop and from his shop, a duplicate hologram was seized and his mobile was seized and during the course of investigation, Ganesh Chourisya stated that Ranjeet Gupta used to give him order for preparing duplicate hologram and he received a sum of Rs.40,000/- from Ranjeet Gupta and on the basis of statement given by Ganesh Choursiya, the present applicants have been implicated for the commission of alleged offences, therefore the report is lodged against the applicants at Police Station - Amanaka, District Raipur (C.G.) for the offences punishable under Sections 318(1) and 336(3) of the BNS, 2023.

3. Learned counsel for the applicant would submit that the applicants are innocent and they have been falsely implicated in offence in question. He further submits that Applicant No.2 is only 18 years old student who has also appeared in examination of Class 12th and on the basis of memorandum statement of the other accused persons, the applicants were arrested by the police. He also submitted that the applicants are not having any criminal antecedents registered against them, therefore, he prays to enlarge the applicants on anticipatory bail.

4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicants. He further submits that in the memorandum statement of other accused persons, names of both the applicants were disclosed for their active participation in the crime in question, 3 therefore, they are not entitled for grant of anticipatory bail.

5. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts & circumstances of the case, allegations levelled against the applicants and further the fact that in the memorandum statement of other accused persons, names of both the applicants were disclosed for their active participation in the crime in question, thus, I am not inclined to grant anticipatory bail to the applicants.

Accordingly, the anticipatory bail application filed on behalf of the applicants - Ranjeet Kumar Gupta and Sujeet Kumar Gupta, under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 in Crime No. 126 of 2025 registered at Police Station - Amanaka, District Raipur (C.G.) for the offences punishable under Sections 318(1) and 336(3) of the BNS, 2023, is rejected.
