This appeal arises out of the order dated 17.10.2025, passed by the District Consumer Disputes Redressal Commission, Burhanpur (for short 'District Commission'), in complainant case No. 18/2025, whereby the District Commission has dismissed the complaint filed by the complainants/appellants, in limine.

Learned counsel for appellants submits that by the impugned order the District Commission has dismissed the complaint at the admission stage on the ground that the though the complainant has submitted that he had made complaint with the Bank, but he has not placed documents on record to show that what action has been taken by the Bank. It has been further observed that the complaint made by the complainant with the Bank Lokpal has also been dismissed. Therefore, the District Commission dismissed the complaint filed by the complainant on the ground that the complainant was unable to prove that there is any deficiency in service on part of the opposite parties. Learned counsel : 2 : further submits that the District Commission ought to have issued notice to opposite party/respondent and after hearing both the parties an order on merits could have passed. She, therefore prays that the impugned order be set aside and the matter be remanded back for deciding it on merits.

Having heard learned counsel for the complainant and on perusal of the impugned order, I am of the view that the District Commission ought to have decided the matter on merits, after hearing opposite party/respondent also. At least notice to the opposite party ought to have been issued and the case could have been decided, when version of opposite party was brought on record.
4. Therefore, without going into the merits of the case, the impugned order is set aside and the case is remanded back to the District Commission for reconsidering the case afresh in accordance with law, on merits, after hearing both parties.
5. Complainant/appellant is directed to appear before the District Commission on 19th January, 2026.
6. With the aforesaid directions, this appeal is disposed of.
