03. 25.06.2010Petitioners are languishing in jail since Februray-
March, 2009 in a case registered under Section 395 of the I.P.C.
It is alleged that on 23.12.2008 seven unknown persons entered into the temple and took away the idols of different Gods, one mobile and cash of Rs. 150/-
It is submitted by learned counsel for the petitioners that on the confession of one Nagendra Sah petitioner Sanjay Kumar name surfaced. It is further submitted by learned counsel for the petitioners that there are two other cases apart from the present one against the petitioners one under Section 379 I.P.C. while other under Section 414 I.P.C. Moreover no actual recovery in the present case has been made from the possession of the petitioners nor they have been put on T.I. parade till date.
Learned counsel for the State submits that from 2 one auto rickshaw some idols were recovered in which these petitioners were found to be sitting and for that two cases one under Section 414 I.P.C. and other under Section 379 Cr.P.C. were lodged.
Considering the period of custody and the fact that petitioners have not been put on T.I. parade in spite of their being in custody for more than a year, let the petitioners namely 1. Ram Chandra Sao 2. Jitendra @ Dhirendra Kumar
3. Sanjay Kumar, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Sakurabad P.S. Case No. 79 of 2008(G.R. No. 2564 of 2008).
It is made clear that the bail bond of the petitioners will not be accepted if they are involved in more than three cases and the Trial Court will be at liberty to cancel the bail bond of the petitioners if they fail to appear on three consecutive dates or they get involved in similar nature of case.
