2. 13/10/2009The petitioner claims that he retired in September,1989 the revised pay scales became effective with effect from 1.3.1989. His pay was not revised accordingly. His gratuity and other retiral entitlements were not calculated in the correct manner. Learned counsel was seeking further time to file supplementary affidavit bringing on record orders passed in the case of petitioner in other cases and clarifying the dues of his claim. In my opinion that would serve no purpose. Petitioner should first make a detailed representation justifying his claim before the Chief Accounts Officer, Bihar State Road Transport Corporation. Such a representation should be filed in detail and with clarity within four weeks from today and on such representation being filed, the same would be considered and disposed of by a detailed speaking order giving full calculations and justifications. If it is found that any amount is due, the same shall be paid to the petitioner within six months of the order being so passed. In any event, the order must be finally passed within two months of the representation being filed. The order as noted above must 2 be a detailed speaking order being facts and figure and must be communicated to the petitioner.
With this observation, the writ petition stands disposed of.
