The Court:- The learned counsel appearing for the removed executor has submitted one letter addressed to the removed executor by the concerned I.O., Phoolbagan P.S. Case No. 58 dated 27.4.2018 under Section 420 IPC stating that there are voluminous documents in the case diary. The learned counsel has prayed for issuing direction upon the present I.O. to bring the case diary for the purpose of inspection by this Court.
The learned counsel for the petitioner has submitted that he has no objection if the I.O. is present with the case diary. 2
The present I.O. of Phoolbagan P.S. case no. 58 dated 27.4.2018 under Section 420 IPC is directed to be present with the case diary along with the documents as referred to in the letter dated 12.01.2024 issued by Mr. Tarun Purkait, S.I., Special Cell (GS) DD, Kolkata Police, Lalbazar.
The I.C., Phoolbagan P.S. is to comply with the said order. List the matter on 24th June, 2024 at 2 pm. The removed executor Mr. Pramod Kumar Daga is present. His personal appearance is dispensed with for the time being.
The learned Registrar, Original Side, is requested to communicate this order to the Commissioner of Police, Kolkata and also to the I.C., Phoolbagan P.S. immediately.
