Information sought

and background of the case:

The Appellant filed RTI application dated 12.07.2017 seeking information 14 Points;

1. Provide number of child labour rescued on 18.05.2017 and 12.06.2017 within SDM Rohini and Alipur area were above 18 years of age. Kindly attach proof or order sheet.

2. Provide number of children/child labours above 18 years of age kept in Alipur Govt. Boys Children home and open shelter home Sector-16 Rohini for some reasons, kindly inform reasons. Kindly attach relevant proof or order sheet.

3. Provide the provisions under J.J. Act 2015 taking into consideration in CWC kept the child labour/children or above in Govt. Home or NGO run home for coming their Bank account opened, Bank Passbook for restorations.

4. Provide number of children of above were not working in the premises, factory, shop despite that Task force rescued them and kept in the Govt./NGO run homes, not immediate released from spot. Kindly attach relevant proof.

5. Provide the statement above children under section 164 Cr.P.C. is pre -

condition for restoration of children to their parent, guardian.

6. Provide the IO supply/gives photocopy of statement of child labour u/s 164 Cr. P.C. to the child welfare committee concerned. Etc PIO/Dy. Director (SCPS), vide letter dated 04.08.2017 furnished the point wise reply to the Appellant.

Dissatisfied with the reply received from the PIO, Appellant filed First Appeal dated 21.08.2017. FAA vide order dated 21.09.2017 upheld the reply of PIO.

Facts emerging during the course of hearing:

Appellant is not present for the hearing. However, one Sh. Arvind Upadhyay has appeared on his behalf.

Respondent states that Appellant has sought voluminous information. However, he claims that adequate information, as available, has duly been provided to the Appellant vide reply dated 04.08.2017 and the same has also been upheld by the FAA.

Decision:

Commission concurs with the decision of the FAA. The available information has been provided by the Respondent, in a timely manner. Upon enquiring from Shri Arvind Upadhyay if there was any specific information which he still wishes to get from the Respondent, Sh. Arvind Upadhyay failed to provide a proper response.

Therefore, Commission observes that no further adjudication is required in the present case. The appeal stands disposed off accordingly, without directions.
