ORDER (ORAL)
Hon'ble Mr. Tarun Shridhar, Member (A) The applicants are employees of Govt. of India Press, who are residing in residential accommodation allotted to them by their organisation. They are aggrieved that the tariff for consumption of water which is being charged from them is exorbitant, as also discriminatory, as several other employees who too are occupants of govt. accommodation in the same campus, are being charged for water consumption at a much lesser rate.
2. Aggrieved, they have filed the present O.A. seeking the following reliefs :
(a) Directing the respondents to place the relevant records pertaining to the the present O.A. before the Hon'ble Tribunal for the proper adjudication in the matter.
(b) Quash and setting aside the impugned orders dt. 24.07.18 (Annexure A/1) read with the order dt. 27.09.18 (Annexure A/2) thereby the respondents decided and enhanced the water charges from Rs. 180 to 500 p.m. for Type-1, Rs. 200 p.m. to Rs. 600 p.m for type-ll, Rs. 250 p.m. to Rs. 800 p.m for type-lll, Rs. 300 p.m. to Rs. 900 p.m for type-IV & Rs. 350 p.m. to Rs. 1100 p.m for type-V arbitrarily for the Press Pool allottees only w.e.f. 01.07.18 at the same time the matter was taken up with the Zonal Revenue Office of Delhi Jal, Board for installation of individual meters for Press Pool allottees that has been rejected by DJB on the grounds that as per their policy individual water connection cannot be sanctioned respectively after declaring the same are as illegal, unjust, arbitrary biased, perverse, malafide, unconstitutional, against the principles of natural justice, violative of Articles 14, 16 16 O.A. No. 2030/2019 Item No. 08 & 21 of the Constitution of India, against the mandatory provisions of law, discriminatory and in violation of the relevant rules and instructions on the subject further
c) Directing the respondents to take the normal rate of water charges as being imposed on the allottees of GPRA accordingly the adjustment may be made of the differences already charged from the applicants accordingly.
c) Allowing the OA with consequential benefits and cost.
d) Any other fit and proper relief may also be granted to the applicants.
3. I have heard the learned counsel for the parties and also gone through the documents on record.
4. This O.A. is now more than three years old and at this stage of final hearing, I am not convinced that this Tribunal has jurisdiction to adjudicate upon the issue which is at hand. However, considering the lapse of three years. I am conscious of the fact that it is too belated a stage to dwell upon the issue of jurisdiction. Further, even if jurisdiction is presumed, there is also the question of competence to decide the issue at hand which essentially requires adjudication upon what should be the correct and reasonable tariff for water consumption. The Delhi Jal Board, impleaded as respondents, has categorically averred in the counter reply that water tariff is determined in accordance with the Delhi Water Board Act and the regulations framed thereunder i.e. Delhi Water and Sewer (Tariff and Metering) Regulations, 2012. 17 O.A. 5. Accordingly, no specific direction is warranted from this Tribunal. However, being conscious of the fact that the case has been lying pending for more than three years, it would be appropriate to dispose of the same with a direction to Respondent No. 2 to take an appropriate decision in the matter, and if need be, in consultation with the competent authority of Delhi Jal Board.
6. The applicants are afforded a liberty of 15 days, if they so wish, to make a representation to Respondent No. 2 in this regard.
7. Pursuant to receipt of such a representation, Respondent No. 2 may take an appropriate decision, as deemed fit, in accordance with the rules and in consultation, as advised above.
8. The O.A. stands disposed of against the background of these directions.
There shall be no order as to costs.
