2 23-06-2015Heard learned counsel for the petitioner and the State.
The petitioner is apprehending her arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.
Accusation is of kidnapping the minor daughter of the informant.
It is alleged against the petitioner that petitioner came to the house of the informant and took the informant's daughter who was subsequently taken away by Chandan Singh, Tunni Kumar and Gagan Kumar. In 164 Cr.P.C. statement the victim got her age recorded as 15 years where she has stated that she of her own went to Nawada and stayed at Nawada Railway Station 5-6 days and she was apprehended by the Police from there. The Patna High Court Cr.Misc. No.20961 of 2015 (2) dt.23-06-2015 2 victim under Section 164 Cr.P.C. statement has not named the petitioner.
Considering the fact that the petitioner is unmarried girl and she has not been named by the victim, let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 105 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
