Section 45(2) in Siliguri Municipal Corporation Act, 1990
(2)Notwithstanding anything contained in this Act, the first meeting of the Corporation for the election of the Mayor and the Chairman shall be presided over by a member to be nominated by the State Government in this behalf:Provided that such member shall not himself be a candidate for such election.
