CRM No. 6809 of 2012 In the matter of an application for bail under Section 439 of the Code of Criminal Procedure filed on 28.04.2012 in connection with Uluberia P.S. Case No. 344/2011 dated 09.04.2011 under Sections 498A/306/34 of the Indian Penal Code.

And In Re : Ajit Haldar & Ors. - petitioners Mr. Santanu Deb Roy ... for the petitioners Ms. Sreyashee Biswas... for the State Heard the learned Counsel appearing on behalf of the parties. Perused the case diary.

The petitioners are seeking bail in connection with a case relating to the offences punishable under Sections 498A/306/34 of the Indian Penal Code, which was registered vide Uluberia P.S. Case No. 344/2011.

The petitioners are the brother-in-law and the sisters-in-law. It is not disputed from the side of the State that these two petitioners are standing on the same footing with the co-accuseds who have been enlarged on bail by this court.

Having regard to such fact and considering the materials collected during investigation as against the present petitioners and when no apprehension has been disclosed from the side of the State that if the petitioners are released on bail they are likely to abscond, prayer for bail is allowed.

Let the petitioners be released on bail to the satisfaction of the learned Additional Chief Judicial Magistrate, Uluberia, Howrah on a bond of Rs. 5,000/- each with two sureties of Rs. 2,500/- each and on further condition that they shall not tamper with the prosecution case and shall not commit any offence while on bail.

The application for bail is, thus, disposed of.
