                           Writ Petition filed under Article 226 of the Constitution of India to
                      issue a writ of cetiorarified mandamus to call for the records of the
                      respondent's impugned order in Memorandum No. C1-9/13129/2016
                      dated 22.11.2016 and quash the same consequently directing the
                      respondent to consider the petitioner's request for redesignation as
                      Assistant Professor.

                                                       ORDER

The present writ petition has been filed challenging the order dated 22.11.2016, rejecting the claim of the writ petitioner to redesignate the post of Special officer as Assistant Professor.

2. The writ petitioner was appointed as a Special Officer in the department of Distance Education in the year 2007. He was discharging his duties to the satisfaction of the respondent University without any blemish. The grievances of the writ petitioner is that he made a representation 04.08.2016 to the respondent University to redesignate the post of Special Officer as Assistant Professor, in view of the fact that the petitioner is fully qualified and eligible for such redesignation.

3. This Court is of the opinion that the redesignation of the post or cadre can never be claimed as a matter of right and redesignations are to be granted by taking administrative decision by the competent authorities. The writ petitioner is already working as a Special Officer in the University and the salary and the service benefits are being paid to http://www.judis.nic.in 3 the writ petitioner by the respondent/University in respect of the post of Special Officer. Thus petitioner has no right to claim redesignation to be granted by the University. Redesignations are the policy decisions, which are to be taken on the administrative level and while redesignating the post of Special Officer as Assistant Professor, the case of the writ petitioner shall also be considered along with all other candidates who are all similarly placed and eligible for such redesignation. This being the fatum the impugned order of rejection dated 22.11.2016 is well in accordance with the service jurisprudence and there is no infirmity as such.

4. Accordingly, this writ petition is dismissed. No Costs. Consequently, connected miscellaneous petition is closed.
