1. This matter is listed pursuant to a letter dated 31st January, 2023, received from Principal District & Sessions Judge PC Act (CBI), Rouse Avenue Court, New Delhi noting that the FIR was registered under Section 67-B of the IT Act and as per Section 28(3) of POCSO Act it is the only Special Court designated under POCSO which has the jurisdiction to try the case. Since there is no Special Court designated under POCSO in Rouse Avenue District Court Complex, the case is liable to be transferred to any other District.
2. Learned Counsel for the CBI appears and states that they will make an attempt to find out as to which jurisdiction the concerned FIR would relate to in order to matter be transferred to that particular jurisdiction to a Special POCSO Court.
