The Advocates on record have abstained from Court work presumably because of the Resolution passed by the Madhya Pradesh High Court Bar Association on 24th April, 2015.
This act is in violation of the dictum of the Supreme Court as indicated in para 35 of the judgment rendered in the case of Ex-Capt. Harish Uppal Vs.Union of India and another (2003) 2 SCC 45. Prima Facie, the non-appearance of the Advocates appearing in this case constitutes professional misconduct. Therefore, issue show cause notice to the concerned Advocates for having abstained from Court work pursuant to the decision of the Bar Association to show cause why appropriate action should not be taken against them including of imposing cost. Issue notice to the concerned Advocates. Returnable on 17.6.2015.
