CENTRAL ADMINISTRATIVE TRIBUNAL AHMEDABAD Order Sheet Item no.: 14 M.A./155/2025 (AHMEDABAD) [ EXTENSION OF TIME ] No of Adjournment: 1 In O.A./146/2024 Order Dated: 30/04/2025 M.A./156/2025 Court No.: 1 AJAYSINH JADEJA Vs AIR FORCE For Applicant(s) Advocate : R R PATEL For Respondent(s) Advocate : PRIYAL SHAH Notes of The Registry Order of The Tribunal Ms. R.R. Patel, counsel for the original respondents present and Ms. Priyal Shah, counsel for the original applicant present through digital mode.

2. Counsel for the respondents mainly submitted as under:-

2.1 Ms. R.R. Patel submits that this Tribunal vide order dated 29.04.2024 has disposed of O.A.146/2024 at admission stage by considering that the claim of the applicant for grant of Dress Allowance is pending before respondent no.1 and direction was issued to consider and decide the claim of the applicant by taking note of various OMs on the subject and also by taking note of orders passed by various benches of CAT within stipulated time limit of 60 days.
2.2 Further, on receipt of the said order the respondents have acted upon it and are in process of complying with the direction issued by this Tribunal but due to some administrative exigency the said direction was not complied with, within given time limit.
2.3 Thereafter, she submits that as the direction issued by this Tribunal was not complied within stipulated time limit, we have filed the present M.A. No.155/2025 for extention of time to comply with the direction issued by this Tribunal vide order dated 29.04.2024 passed in O.A./146/2024 and have also filed M.A.156/2025 for condonation of delay in filing the M.A. for extension of time as due to some defect in the cause title the said M.A. for extension of time could not be filed within stipulated time limit.
2.4 Counsel also submitted that in para 3 of the MA it has been stated that after undertaking various administrative procedure, the case of the applicant is now at the stage of financial approval and the said stage would need some time. Hence, this Tribunal is requested to allow the said M.A.155/2025 for extention of time to comply with the direction of this Tribunal.
3. On the other hand, counsel for the applicant objected for grant of further extension of time as prayed for by the original respondents in the M.A.155/2025 and submitted that already ten months have been over and yet the respondents have not considered the claim of the applicant.
4. Heard learned counsel for the parties and perused the material available on record.
5. Considering the aforesaid submissions, I am of the opinion that since the respondents have declared in their M.A.155/2025 that the case of the applicant has been processed and is only awaiting financial approval to comply with the direction issued by this Tribunal in O.A./146/2024 on 29.04.2024.

It can be seen that sufficient grounds have been mentioned in M.A.156/2025 (CoD) & in M.A.155/2025 (EOT). Therefore, both the MAs are allowed. Accordingly, respondents are granted 45 days from today to decide the claim of the applicant and intimate the deicison to him at the earliest. It is made clear that no further time will be granted.

6. In view of the above, M.A.155/2025 and M.A.156/2025, both stands allowed.
