1. Mr. Vishnoi, learned counsel for the petitioner submits that in identical matter being S.B. Civil Writ Petition No.10270/2021 :
Gharsana Gram Seva Sahkari Samiti Vs. The State of Raj. & Ors., on 10.08.2021, a coordinate Bench of this Court has passed the following order:
"Learned counsel for the petitioner has argued that the respondents have proposed to divide the petitioner-Society by creating a new cooperative society. It is argued that before initiating any proposal for dividing a cooperative society, the (Downloaded on 27/10/2021 at 09:27:14 PM) (2 of 2) [CW-14355/2021] respondents are required to follow the procedure laid down under Section 13 of Rajasthan Cooperative Societies Act, 2001 and Rule 13 of the Rajasthan Cooperative Societies Rules, 2003, however, no such procedure has been followed by the respondents. Issue notice. Issue notice of stay application also, returnable on 01.09.2021.
In the meantime, status quo, as it exists today, shall be maintained till the next date."
