ORDER
This Writ Petition has been filed in the nature of Mandamus, seeking a direction to the respondents 1 and 2 to take necessary action as against the respondents 3 to 7 herein, on the basis of the petitioner's representation dated 02.05.2022.
2.The learned Counsel appearing for the petitioner submitted that the petitioner's father Veeraiyan, borrowed a sum of RS.50,000/- from the third respondent/Renganayagi, in the year 2017, for his agricultural development work. He repaid the same with interest for a sum of Rs.30,000/- to the third respondent in the year 2019. But, the third respondent demanded more interest from her father. There was a family dispute between the petitioner's 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.11204 of 2022 father and the respondents 4 and 5. On 23.04.2022 at about 7.00 pm, the third respondent along with the sixth respondent came to her house, abused the petitioner and her mother and also tried to attack them. Therefore, she lodged a complaint before the second respondent, on 24.04.2022. The police received the complaint, but he has not taken any action. Hence this petition has been filed.
3.The learned Government Advocate (Crl.Side) submitted that based on the complaint lodged by the petitioner, CSR.No.55 of 2022 has been registered, both parties were summoned by the police for enquiry and enquired them. Subsequently, they were not co-operated for concluding the investigation.
4.Heard both sides.
5.I have considered the matter in the light of the submissions made by both the Counsels. It appears that there was a dispute between the petitioner and the respondents 3 to 7. In this respect, the petitioner lodged a complaint and for the same CSR.No.55 of 2022 has been assigned and enquiry has been 3/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.11204 of 2022 conducted, but it was not continued, due to non-cooperation of the parties.
6.In view of the above, the second respondent is directed to speed up the enquiry and conclude the investigation and consider the representation given by the petitioner.
7.With the above direction, this writ petition stands disposed of. No costs.
