9 21-07-2016Heard the parties.
Third supplementary counter affidavit has been filed pointing out that petitioner nos. 5, 13, 15, 16 have not been granted the benefit of non-practicing allowances on the ground Patna High Court CWJC No.6620 of 2013 (9) dt.21-07-2016 3/3 that they themselves not got registered in the Bihar Veterinary Council by 31.05.2000 that was the due date for receipt of the application by the Doctors. Rest persons have been granted the benefit of non-practicing allowances. As per the petitioners, incorrect date has been given with regard to rest petitioners for entitlement of benefit of non-practicing allowances, as submitted by the counsel for the State on instruction of the Director of Animal Husbandry that the error in date crept in letter dated 8/7/2016 will be corrected within four weeks.
In such view of the matter, there is no need to proceed further. The persons, who have not been given the benefit, will have liberty to make representation before the appropriate authority, who will consider their cases and pass necessary order in accordance with law.
With the above observation/direction, this petition is disposed of. The Director, Animal Husbandry is physically present in the Court. In view of disposal of this case, there is no need for his personal appearance any further.
