(1) This Letters Patent Appeal is directed against the interlocutory order dated 22.05.2017 whereby learned Single Judge has stayed operation of the order dated 10.05.2017 vide which services of respondent No.1 were terminated.

(2) Notice of motion to respondent No.1 only at this stage. Mr. Alok Mittal, Advocate who is present in Court accepts notice on his behalf. (3) Having heard learned counsel for the parties, we are not inclined to interfere with the interim order passed on 22.05.2017 for the reason that the appellant can always raise its contentions at an appropriate stage before the learned Single Judge. However, in view of the nature of controversy and urgency involved, the next date of hearing before the learned Single Judge is preponed from 12.10.2017 to 02.08.2017. Resultantly, the next date of hearing in CWP No.26681 of 2013 shall also stand preponed for the same date. (4) It is clarified that while the first respondent shall be entitled to draw his salary in view of the stay order granted by learned Single Judge, 1 of 2 ::: Downloaded on - 10-06-2017 18:54:07 ::: LPA No.990 of 2017 -2- however, the appellant-Corporation shall be at liberty to not to assign any duties till the decision of the writ petition.
