HON'BLE JUSTICE MR. KALIDAS MUKHERJEE, PRESIDENT               This Transfer Application has been filed by the Complainant/Petitioner praying for transfer of the case bearing no.268 of 2015 from Learned District Forum, Barasat, North 24-Paraganas to any other Forum within Kolkata. 

 

            The Learned Counsel for the Petitioner herein has submitted that the Complainant is the Assistant Commissioner of Police (Administration), South East Division of Kolkata Police and he is aged 59 years.  It is submitted that the Complainant remains busy in the discharge of his official duties and, as such, it is very difficult to attend the Learned District Forum, Barasat, North 24-Paraganas.

 

            The Learned Counsel for the OP has opposed the petition. 

 

            We have heard the submission made by both sides.  From the submission of both sides it appears that the evidence has been adduced by the parties and the matter is pending at the stage of argument.  Having regard to the fact that the case has almost reached its finality being pending at the stage of argument, there is no ground to transfer the case from the Learned District Forum, Barasat, North 24-Paraganas.
