Section 159(iii) in The Naval Ceremonial, Conditions Of Service And Miscellaneous Regulations, 1964
(iii)The time served as Acting Sub-Lieutenant, shall if the officer is not confirmed, count as Chief Petty Officer's time unless failure to obtain confirmation is due to misconduct not meriting discharge from service in which case the time served in the acting capacity shall count as time in the rating held prior to appointment as Acting Sub-Lieutenant.
