By of this civil application, the applicant
-State has prayed to clarify the words "carrying on the work at the hospital" in order dated 15.6.2015 and to direct the opponents not to construct further on the land in question and maintain status-quo. The same is clarified and it is undertaken by Mr. Shalin Mehta learned senior advocate that all construction will be subject to the result of the petition and even the lis pending dispute taken up in this civil application will be taken up in the main matter It is clarified that this Court while passing Page 1 of 2 HC-NIC Page 1 of 2 Created On Fri Oct 16 02:28:54 IST 2015 C/CA/9888/2015 ORDER the order dated 15.6.2015 had mean that carrying on the work at the hospital would be of the existing structure and no further construction and if the same is made in violation, the same will be subject to the result of the petition. With this clarification, this Civil Application is disposed of. All the photographs which are placed as part of this Civil Application will form part of the reply of the State before the concerned Court in the main petition.
By consent and as requested by the learned advocates appearing for the parties, the main matter to be listed on 20.10.2015 before the appropriate Court taking up such matters.
