             Accused is absent.

It is submitted by the complainant that he has compounded the matter with the accused and his statement to this effect has been recorded separately.

In the judgment of Hon'ble High Court of Kerala titled Y.P.Baiju vs. State of Kerala, 2008 CrLJ 928, it was held that matter can be compounded even in the absence of the accused.

Thus, in view of the statement, matter stands compounded and the same stands disposed of as settled. The accused is hereby acquitted of the offence charged of. Personal bonds/surety bonds, if any, stands cancelled. Endorsement, if any are also cancelled. Sureties, if any, stand discharged. Original documents of the surety, if any be returned to the surety against proper receipt. Case property, if any, seized by the IO be also released to the lawful owner against acknowledgment.

Since nothing remains to be adjudicated in the present case, let the file be consigned to the record room after necessary compliance.

Copy of this order be given dasti.
