ORAL JUDGMENT
(Per: HONOURABLE THE CHIEF JUSTICE) Date : 23-06-2022 Heard learned counsel for the parties. Petitioners have prayed for following reliefs:-
Patna High Court CWJC No.8563 of 2022 dt.23-06-2022 5/8 Patna High Court CWJC No.8563 of 2022 dt.23-06-2022 6/8 Patna High Court CWJC No.8563 of 2022 dt.23-06-2022 7/8 It is not in dispute that petitioners' selection and appointment is in terms of resolution dated 25.01.2018 (Annexure 1) which itself contains the clause that petitioners' appointment as Guest Teacher shall be only till such time the regular appointment is made. The relevant portion of the Clause is extracted as under:-

Petitioners were appointed as Guest Teacher way back in the year 2018 and the present petition is filed on 13.06.2022.
Both on merits and on the ground of delay and laches, the petition needs to be dismissed.
The petitioners were fully aware of their terms of selection and appointment. They were appointed only as Guest Teachers, for a temporary period, by way of an interim arrangement, till such time the post could be filled up to regular appointment. They were entitled to fixed amount of honorarium.
As such, petitioners' contention that their appointment may be treated as regular in terms of the Bihar District Board Patna High Court CWJC No.8563 of 2022 dt.23-06-2022 8/8 Secondary and Senior Secondary Teachers' (Employment and Service Conditions) Rules, 2006 as also the Bihar Municipal / Local Bodies Secondary and Senior Secondary Teachers' (Employment and Service Condition) Rule, 2006 is totally misconceived and legally untenable in law.
Hence, on all counts, the present petition stands dismissed.
Interlocutory application, if any, shall also stand dismissed.
