1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Ministry of New and Renewable Energy, Govt. of India, New Delhi, seeking information on five points pertaining to promotion given to one Shri Gaj Raj Singh under Flexible Complementing Scheme (FCS) and Modified Flexible Complementing Scheme (MFCS) including, inter-alia, (i) note sheets, proposal, assessment reports (Stage 1 Page 1 of 4 and Stage 2) for assessment under the scheme, and (ii) references, if any, made to DoPT or any other dept. in respect of promotion of Shri Gaj Raj Singh.
2. The appellant filed a second appeal before the Commission on the grounds that the CPIO has not provided the information sought for stating that the same is voluminous. Whereas, the information sought for relates to only one scientist and is readily available with the Ministry. The appellant requested the Commission to direct the respondent to provide the desired information to him.
Hearing:
3. The appellant was not present despite notice. The respondent Shri Sandeep Mukherjee, Under Secretary and CPIO and Shri Gangesh Upadhyay, Director (Admn.), Ministry of New & Renewable Energy, New Delhi were present in person.

The respondent submitted that the appellant was informed vide letter dated 05.05.2017 that the information sought regarding note sheets, proposal, assessment report for promotion of Shri Gaj Raj Singh under FCS and MFCS, including, references made to DoPT for his promotion and recommendations/report received from FCS/MFCS Committee or DoPT is voluminous in nature, collating and compiling of which would disproportionately divert the resources of the respondent organization. Hence, its disclosure is exempted under Section 7(9) of the RTI Act. Moreover, the information sought pertains to a third party, Shri Gaj Raj Singh, the disclosure of which has no relationship to any public interest and would cause an unwarranted invasion of the privacy of the third party.
Page 2 of 4Nonetheless, the appellant was requested to inspect the relevant records. However, he chose not to inspect the same.
Decision:
5. The Commission, after hearing the submissions of the respondent and perusing the records, observes that the appellant has sought information regarding promotion given to one, Shri Gaj Raj Singh under Flexible Complementing Scheme and Modified Flexible Complementing Scheme which pertains to a third party, namely Shri Gaj Raj Singh the disclosure of which has no relationship to any public interest and would cause an unwarranted invasion of the privacy of the third party. Nonetheless, an opportunity to inspect the relevant records was given to the appellant. Hence, no further intervention of the Commission is required in the matter.
6. With the above observations, the appeal is disposed of.
7. Copy of the decision be provided free of cost to the parties.
