O R D E R

(DELIVERED BY HONBLE MS. JASMINE AHMED, MEMBER (J)) By way of this present original application filed under section 19 of Administrative Tribunals Act 1985, the applicant has prayed for the following reliefs:-

a) To issue a suitable order or direction to the respondent no.3 to issue the admit card to the applicants for written examination in pursuance to the employment notice no.34303/LRS12-13/EIB(S) as published employment news paper dated 13-19 December 2014 followed by interview.
b) To issue a suitable order or direction to the respondent no.3 to decide the pending representation of the applicants dated 18.06.2015 (Annexure No.A-3 to the O.A.) a reasoned and speaking order.
c) To issue any other order or direction to respondents, to which this Honble Tribunal may deem fit and proper under the facts and circumstances of the case.
d) Award the cost of the application in favour of the applicants.

The counsel for the applicant stated that in pursuant to the employment notice issued by the Military Engineering Service, Delhi issued in Employment News dated 13-19 December, 2014 for Recruitment of various posts the applicant herein applied for the post of Mate. It is the contention of the counsel for the applicant that the applicants are fully eligible to apply for the post of Mate. He also contends in the first week of April 2015 the respondent no.3 issued admit cards to various similarly situated applicants to appear in the written examination schedule to be held on 10.5.2015. It is his contention that as no admit card was issued to the applicants, few of the applicants preferred a common representation to respondent no.3 dated 18.6.2015 but till date no reply has been given to them. The counsel for the applicant states that in OA No.588 of 2015 an order was passed by this Tribunal in a similarly situated matter directing the respondents to allow the applicants to appear in the written examination scheduled to be held on 10.5.2015 at Agra on production of copy of that order as no admit card was issued to the applicants in that O.A. The counsel for the applicant states that the facts and circumstances of this present original application is similar to that of O.A. No.588 of 2015. Accordingly the same relief should be granted in this OA also.

3. We failed to understand that how the similarity can be drawn between these two OAs. In OA no.588 of 2015 the applicants approached this Tribunal on 8.5.2015 whereas the scheduled date of examination was 10.05.2015 which is two days prior of the exam to be held. Here in this case two months is almost over from the date, the exam has taken place. The process of selection through written examination has already been completed. Now at this belated stage when the written examination has been completed before two months giving a direction for issuance of admit card will be misplaced direction as it will dislocate the entire situation and the process of selection will unnecessarily be held up.

4. In our considered view the original application lacks merit and the same is accordingly dismissed. No Costs.
