BAGEWADI, MEMBER The Appellant/Opposite Party No.2 being aggrieved by the order dated 20-11-2017 passed by the District Consumer Commission, Davanagere in Complaint Nos.10/2017 to 51/2017 respectively.
2. The Appellant is the same in all these Appeals and the facts involved in these Appeals are one and the same. Hence, these Appeals are taken up together and are being disposed of by a common order.
3. The brief facts of the complaints are that all the complainants of these 42 cases are the members of the opposite party No.3/Society (PACS) of Yaraganalu Village. All of them (3 members for groundnut crop) had deposited their respective insurance premium amount for insuring their maize crop of the year 2014-15. The said amount remitted to the opposite party No.1 was deposited with opposite party No.2/DCC Bank and thereafter it was transferred, with required documents to the opposite party No.1/Insurance Company. Subsequently, both the Government and the opposite party No.1/Insurance Company conducted the joint survey and assessed the loss of the crops in the insurance covered areas of various villages and accepted loss to the extent of 59.57% to the areas of Guddehalli and Belagutti Village and also to the crops of the complainants. The complainants of all these cases approached the opposite party No.3/ (PACS) with claim papers for the insurance amount. In response to the demand for their respective insurance amount, the opposite party No.1 and later the opposite party No.2, gave evasive answers, in spite of written submissions made to them, though the insurance amount was disbursed to the other Agricultural Societies of other villages. All the opposite parties had assured, but did not disburse their respective insurance amount, despite issue of the common legal notice dated 26/9/2016 and hence they were constrained to file these complaints.
4. The opposite parties No.1 to 3 filed their versions separately, in all the complaints contending commonly. The Opposite Party No.1 contended that as the claimed/declared insurance amount was already settled, on the basis of the furnished data, by depositing the same with the opposite party No.2/DCC Bank, through NEFT in /June-July/2015 itself. As per the guidelines contained in MNAI Scheme, the separate list, with all the details about the released amount of the said 42 complainants/farmers, were furnished to the opposite party No.2. There is mandate on the opposite party No.2 to disburse the released insurance amount to the concerned loanee/non-loanee farmers within 7 days, by publishing it on the notice boards of the branches and to send the copy of the compliances with utilization certificate within 15 days to the insurance company for verification and audit. The opposite party No.2 has not complied the same. If the insured farmers have not received their claims, it does not become liable to pay any compensation. Instead of proceeding against the opposite party No.2, the complainants wrongly impleaded and proceeded against insurance company, though question of deficiency in its service and in issuing reply to their legal notice did not arise. There is no cause of action against it. Hence, all the complaints are liable to be dismissed.
The opposite party No. 2 and 3 commonly contended that the insurance premium amounts of the loanee/non-loanee, including the complainants, were collected by the opposite party No.3 and deposited with the opposite party No.2 and the same was sent to the opposite party No.1. After the joint survey was conducted, the government and the opposite party-1 assessed the loss of the crop to the extent of 59.47% and the opposite party No.1 released the insurance amount to other societies but not to the opposite party-3 society, where all these 42 complainants deposited the premium amount in its favour. Their function in making arrangement for remitting the premium amount and disbursing the amount between the complainants and the opposite party 1, only to act as mediators only and hence, there is no deficiency on their part.
5. After trial, the District Consumer Commission, Davanagere has allowed the complaints against the Opposite Party No.2/DCC Bank and dismissed the complaints against the Opposite Party Nos.1 and 3.
6. Being aggrieved by the said order, the Opposite Party No.2/Davanagere District Central Co-operative Bank Limited filed these Appeals before this Commission.
7. Heard the arguments from Respondent No.1 in all cases. Respondent No.2 and 3 placed exparte. In spite of sufficient opportunity has been granted the Appellant has not argued the matter.

Perused the appeals memo, the order passed by the District Consumer Commission, Davanagere and materials on record, we noticed that, it is not in disputed that, all the respondents are the farmers of Guddehalli and Belagutti villages and they are non-loanees of the Opposite Party No.3/Prathamika Krushi Pattina Sahakara Sangha ®, Yaraganalu, Davanagere district. It is also not in disputes that, these all 39 respondents have paid the premium in respect of their Maize crops and 03 respondents have paid the premium in respect of their Ground nut crops in favour of the Respondent No.2/Insurance Company under the National Crop Insurance Programme (NCIP) modified as National Agricultural Insurance Scheme (MNAIS). The said insurance scheme was implemented vide order dated 1-11-2013 of Ministry of Agricultural and Co-operation of Government of India, subject to the terms and conditions. It is also not in dispute that, the loss of insured crops to the extent of 59.57% and it is also not in dispute that, the claim forms were submitted by the respondent No.3 through letter dated 11-8-2015 to the appellant and the appellant has submitted it to the Respondent No.2/Insurance Company.

The allegations of respondents in all the cases are that even though the Insurance Company/Respondent No.2 released the assessed insurance amount of their respective crops to the society of the said insurance coverage even the appellant did not release the amount and the respondents sought direction to release the insurance amount of their respected crops of the year 2014-2015 along with separate expenses, compensation, litigation cost and interest on the said amount.

Perused the order passed by the District Consumer Commission, Davanagere we noticed that it is evident that, the Respondent No.3 requested the appellant to release the crop insurance amount for 23 farmers of Guddehalli village and 03 farmers of Belagutti village for loss of crops. Hence Respondent No.3 exercises his duty properly. The appellant in appeal memo contended that at the time of insurance claim raised by the respondent, the appellant has immediately intimated and requested the demand of the claim but the Respondent No.2/Insurance Company did not bother to release the amount on time, after several reminders and due to which the appellant did not release the claim amount in time. However the letter communication between the appellant and respondent No.2/Insurance Company discloses that the respondent No.2 has released the claim amount of farmers/beneficiaries in 2015 itself and as per the Regulation No.22.2 (ii), the appellant has to release the amount within 7 days to the beneficiaries and send the copy to the concerned Insurance Company with utilization certificate within 15 days. However the appellant has not made such and violated the Regulation No.22.2 (ii), hence there is also no fault on the side of the Respondent No.2. The appellant in appeal memo further contended that when the Respondent No.2 released the amount of the claim, the appellant has deposited a sum of Rs.6,82,612/- dated 7-10-2017 before the Hon'ble District Consumer Commission and the appellant has assured to deposit the balance amount which was only small amount and as soon as they get from the Respondent No.2/Insurance Company. The appellant has deposited the amount to distribute as per individual claim of the respondents. However the presiding officer of Commission/Forum below changed and then the new presiding officer did not look into the matters already discussed and passed one sided order and awarded. The appellant further contended that the appellant is only nodal bank and it is get from 4% commission on the amount collected on insurance premium which is a small amount and released the crop insurance amount of Respondent No.2 in favour of Respondents within 30 days with interest @12% p.a. and then paid the litigation charges of Rs.10,000/-. Being the contrary to the material placed on record and terms between the parties which required to be set aside the order and prays to set aside the order.

Perused the order passed by the District Consumer Commission, on the basis of particulars of furnished data, the Respondent No.2 calculated and declared the insurance amount to the Respondents in all the cases. Moreover, it is also evidence that the appellant had received the excess amount of Rs.2,09,696.20 then it is the duty of the appellant to distribute the same to the member of societies coming within the jurisdiction, but the appellant has not made such attempts. Moreover in spite of receiving the amount from the Respondent No.2, the appellant has not released the same to the farmers/beneficiaries or return to the Respondent No.2/Insurance Company which is deficiency of service on the part of the appellant. Perused the order passed by the District Consumer Commission, the District Consumer Commission has directed the appellant to release the crop insurance amount in favour of respondents within 30 days, in default to pay interest @12% p.a. till realization without considering that the appellant has deposited Rs.6,82,612/- dated 7.10.2017 before the District Consumer Commission to distribute the said amount to the beneficiaries/farmers which is not in accordance with law. Admittedly, the appellant is a nodal bank and it gets only 4% commission on the amount collected as insurance premium and it is a public sector. Hence, considering the deposited amount by the appellant, we are of the opinion that the order of District Commission for compensation of 25% of released insurance amount and in default to pay interest @ 12% p.a. is too much or higher side. Hence, considering the facts and discussion made here we are of the opinion that, the order passed by the District Consumer Commission, Davangere is required to be modified. Accordingly, the appeals are disposed off.
O R D E R The Appeals are disposed off.
The Appellant is directed to pay the released crop insurance amount of the Respondent No.2/Insurance Company in favour of the Respondent No.1 in each case within 30 days along with 8% interest from date of filing the complaint till realization.
Further the Appellant is also directed to pay compensation to all the Respondents @ 10% of the respective released insurance amount.
Further the Appellant is directed to pay litigation expenses of Rs.10,000/- each to the Respondents.
The amount in deposit shall be transmitted to the concerned District Consumer Commission to pay the same to the complainants.
Keep the original of this order in Appeal No.2592/2017 and copies thereof in connected files.
