HON'BLE MR. JUSTICE SUNIL BENIWAL Order 09/01/2026
1. The instant misc. application [in Review Petition (Writ) No.105/2025 - Mukesh Kumar Choudhary & Ors. Vs. Goverdhan Kumar & Ors.] has been preferred claiming the following reliefs:
"a. Kindly allow the present petition and modify the order dated 06.11.2025 to the extent of replacing the unamended case title with the amended case title, already on record.
b. Pass any other appropriate order or direction which the Hon'ble Court deems just and proper in the facts and circumstances of the case and interest of justice."
2. Learned counsel for the applicants (review petitioners) submits that the above-numbered review petition No.105/2025 alongwith the connected matter was listed on 06.11.2025, when arguments on the review were heard in full and an order was passed (Uploaded on 15/01/2026 at 02:13:04 PM) (Downloaded on 15/01/2026 at 08:21:26 PM) [2026:RJ-JD:1136-DB] (4 of 4) [ dismissing the said review petitions vide order dated 06.11.2025. Learned counsel however, submits that the cause title therein reflects the unamended version, whereas the amended cause title had already been taken on record well before the date of the final hearing i.e. 06.11.2025.
3. For the reasons mentioned in the present application and the submissions made on behalf of the applicants (review petitioners), the same is allowed. Accordingly, the unamended cause title, that formed part of the order dated 06.11.2025 passed in D.B. Review Petition (Writ) No.105/2025 is substituted by the amended cause title as already brought on record in the said review petition and the same shall form part of the aforesaid order dated 06.11.2025 and thus, the said order shall be read accordingly.
