HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA Order 01/05/2020 Defects are overruled for the present. Heard on merits.
Counsel for the petitioner submits that the demand for the royalty collection is for the period from 1.4.2020 to 30.4.2020 i.e. the period during which lockdown was in force and therefore there could be no royalty collection conducted during the said period, hence counsel submits that the demand is unjustified. Learned counsel further submits that the contract has been cancelled and possession has been taken on 27.4.2020, although the actual possession has not been taken.
Issue notice of the writ petition as well as stay application, returnable within four weeks.
In the meanwhile, the effect and operation of the orders impugned dated 10.4.2020 and 27.4.2020 shall remain stayed and the petitioner shall not be asked to pay the amount for the lockdown period and the petitioner's bank guarantee shall not be encashed and no coercive steps shall be taken as against him.
