Mr S B Solat is present for the appellant. Adv. Mr D M Gabhane is present for the respondent. Adv. Mr Solat filed a Pursis on last date stating that Shri Bhaurao Dhondbaji Nerkar, who filed the present appeal, died on 07.09.2013 and he has no further instruction from his Legal Representatives in this appeal. He also made similar statement orally before us.
In view of the said Pursis, it is clear that the appellant died on 07.09.2013 and the Legal Representatives are not brought on record till this date.
Hence, appeal is dismissed as abated.
