       Mrs. J. Pandit, learned Government Advocate for the respondents.

The petitioner has filed the present petition, under Article 226 of the Constitution of India, praying for a direction to consider his case for promotion to the post of Sub-Inspector.

Learned counsel for the petitioner submits that the petitioner was inflicted with minor penalty, however inspite of elapsed of period of punishment his case was not considered for promotion. He, therefore, prays that the petitioner may be granted a liberty to file a representation before respondent No.3 and respondent No.3 may be directed to consider and decide his representation within stipulated period of time.

Learned Government Advocate does not opposes the prayer of the petitioner and fairly stated that suitable action shall be taken in the matter.

In view of the submissions made by learned counsel for the parties, this petition is disposed of with a direction to the petitioner to file a representation before the competent authority within a period of 15 days from the date of receipt of certified copy of the order passed today and respondent No.3 is directed to consider and decide the representation submitted by the petition within three months thereof by a speaking order. It is made clear that this Court has not expressed any opinion on the merits of the case.

With the aforesaid observation, the petition stands disposed of.
