1. Petitioner herein is original respondent in arbitration proceedings pending before the Court of learned 12 th Additional District Judge, Surat in Civil Miscellaneous Application DC (Arbitration Application) No.356 of 2019. The challenge is to the order dated 30.12.2019 on the part of this petitioner, since it is aggrieved by the direction of 60% of the awarded amount to be deposited, instead, unconditional stay of arbitral award dated 12.11.2019 has been sought.

3. Noticing the fact that the matter has been finally heard before the trial Court concerned and it is now posted for bringing the entire record before the Court with final submissions having been concluded, this petition would not survive. Resultantly, the present petition is being disposed of without entering into the merit with a permission to approach this Court in the event of any difficulty. This, in no manner, shall prejudice the final outcome of the matter.

4. Petition stands disposed of accordingly.
