                                        ORDER

1. Shri Kopelo Letou, the appellant, sought information as to whether a person who had obtained a Bachelor of Engineering (BE) degree, an M.Tech degree in Computer Science and was a Ph.D. holder in Mathematics, was eligible for the post of Assistant Professor in Mathematics in Universities/Colleges/Institutions.

2. The CPIO provided the appellant a copy of clause 4.4.1 of the UGC Regulations on minimum qualifications for appointment of teachers and other academic staff in Universities and Colleges. Dissatisfied, the appellant approached the FAA stating that he was not satisfied with the CPIO's reply to his RTI application and requested the FAA to provide him the desired information. The FAA upheld the decision of the CPIO. Aggrieved, the appellant came in appeal before the Commission stating that he was not satisfied with the response of the CPIO and the FAA as the information provided to him was not clear and specific about eligibility criteria for the post of Assistant Professor and requested the Commission to direct the CPIO to provide him the requisite information.

3. The matter was heard by the Commission. The respondent stated that the appellant sought clarification as to whether a person with qualification of Bachelor of Engineering and M.Tech in Computer Science and Engineering, with over 60% marks and Ph.D degree in mathematics was eligible for the post of Asstt Professor in Mathematics. The respondents further added that the appellant was seeking clarification and they had provided the relevant regulation 4.4.1.iii of UGC Regulations on minimum qualifications for appointment of teachers and other academic staff in universities and colleges and measures for the maintenance of standards in higher education, 2010 which states "notwithstanding anything contained in sub clauses 1 and 2 of this clause 4.4.1, candidates, who are, or have been awarded a Ph.D degree in accordance with the University Grants Commission (Minimum Standards and Procedure for award of PhD degree) Regulations, 2009, shall be exempted from the requirement of the minimum eligibility condition of NET/SLET/SET for recruitment and appointment of Asstt Professor or equivalent positions in universities/colleges/institutions". The appellant was not present to point out any shortcoming in the decision.

4. On hearing the respondents and going through the available record, the Commission finds that the respondent authority has provided the available information and they are not obligated to provide clarifications and interpretations and create information to satisfy the information seeker. The appeal is disposed of.
