HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 26/05/2022 Heard. Perused the material available on record. The convict-petitioner Sunil Kumar @ Sanwarmal S/o Shri Mangal Chand seeks emergent parole for the purpose of appearing in B.A. Part-I Examination-2022 (Non-Collegiate) to be convened by Pandit Deendayal Upadhyaya Shekhawati University, Sikar.

Learned AAG submitted a factual report as per which, all the convicts who are lodged in the Central Jail, Bikaner have been provided the opportunity to study and pursue the graduation and post graduation courses through the Indira Gandhi National Open University. An examination centre has also been arranged for this purpose in the prison premises. The petitioner applied for the B.A. (Downloaded on 31/05/2022 at 08:24:59 PM) (2 of 2) [CRLW-208/2022] Part-I Examination from Pandit Deendayal Upadhyaya Shekhawati University, Sikar without seeking permission from the jail authorities and hence, his prayer for emergent parole has been opposed.

In view of the facts noted above, we are clearly of the opinion that the petitioner intentionally applied for appearing in the B.A. Part-I Examination through Pandit Deendayal Upadhyaya Shekhawati University, Sikar so as to claim emergent parole. Nothing prevented the petitioner from applying for graduation course through the I.G.N.O.U. by availing the facility provided by the prison authorities. Thus, the petitioner is not entitled to be released on emergent parole.

The writ petition is dismissed.
