"a) To pass an appropriate order directing the concerned respondents to recruit the applicant as per the judgment passed by the Hon'ble Justice Dipankar Datta and Hon'ble Justice Protik Prakash Banerjee in W.P.C.T 49 of 2017 (in re: Bipul Kumar Biswas and Others -v Union of India and Others) dated 24.04.2020 for the posts as advertised in connection with employment notice being no employment notice no EN-0112/2012 dated 01.10.2012 as the applicant standing with the same footing with.the litigants in the said matter Forthwith;
b) To pass an appropriate order directing the concerned respondents to transmit and r authenticate the records and documents in regard to the instant case before this Hon'ble Tribunal so that conscionable justice may be done upon hearing the parties.
c) Such further and other order or orders be passed and/or direction or directions be given as this Hon'ble Tribunal may deem fit and proper."
2 As the applicants in each of these O.As pray for the same relief and, would base their claims on similar set of facts, as well as application of the judicial ratio contained in the same judgment, all the abovenoted OAs are being disposed of with a common order.
3. Heard Id. Counsel for both sides. Examined documents on record, as well as the order of the Hon'ble Apex Court in Petition (s) for Special Leave to Appeal (C) No. 11748/2020 (Arising out of impugned final judgement and order dated 24.04i2020 in WPCT No. 49/2017 passed by the High Court at Calcutta in (Unioh of India & Ors versus Bipul Kumar Biswas & Ors,)t as furnished by Id. Counsel for the respondents during hearing.

Counsel for the applicant would submit that the law with regard to normalization (in awarding marks of candidates appearing on various venues/sessions with different sets of question papers) has been laid down by the Hon'ble High Court at Calcutta in WPCT 49/2017 (Bipul Kumar Biswas and Others vs Union ofIndia and Others) and other batch cases, particularly, 9 10 oa 350/1099/2020, o.a. 350/1100/2020, o.a. 350/1101/2020, o.a. 350/1102/2020, o.a. 350/1103/2020, ok 350/1104/2020, o.a. 350/1117/2020, o.a. 350/1118/2020 , o.a. 350/1123/2020, o.a.. 350/1124/2020, o.a. 350/1125/2020, o.a. 350/1126/2020, o.a. 350/1127/2020, y o.a. 350/1136/2020, o.a. 350/1137/2020,o.a. 350/1145/2020, o.a. 350/1146/2020, o.a. 350/1147/2020, o.a. 350/1149/2020, o.a. i 350/1150/2020, o.a. 350/1162/2020, o.a. 350/1173/2020, o.a. 350/1174/2020, o.a. 350/1175/2020, o.a. 350/1176/2020, o.a. 350/1187/2020, o.a. 350/1188/2020, o.a. 350/1189/2020, o|.a. 350/1190/2020, o.a. 350/1191/2020, o.a. 350/1192/2020, o.a. 350/1207/2020, o.a. 35o)l208/2020, o.a. 350/1209/2020, o.a. 350/1226/2020, o.a. 350/1227/2020, o.a. 350/1228/2020, o.a. 350/1229/2020, o.a. 350/1343/2020 and o.a. 350/1148/2020 with reference to the underlined condition that such normalisation can be resorted to when there was an established difference in the level of difficulty in question papers in different shifts/sessions.
The applicants would, therefore, pray that the respondents be directed to dispose of their representations at Annexure A*4 to the O.A, in which they have prayed for appointment in the light of judgement in WPCT 49/2017, supra, in a time bound manner.
5. Ld. Counsel for the respondents would, per contra, argue that the judgement and orders of the Hon'ble High Court in Calcutta in in WPCT 4 49/2017, supra, was challenged by the Union of India in the Hon'ble Supreme 3£ W t) Court and, upon hearing, the Hon'ble Supreme Court had directed as follows--
"Issue notice.
The respondent appearing on caveat is allowed four weeks' time to file counter affidavit.
In the meantime, the impugned direction dated 24.04.2020 issued by the learned Division Bench shall not be given effect to."
6. Both Ld. Counsel would agree that these Original Applications can be disposed of by directing the competent respondent authority to dispose of the pending representations in the light of the Hon'ble Supreme Court's orders whenever the matter is decided by the Hon'ble Supreme Court.
7. 8. The O.As stand disposed of accordingly. No costs.
