And In Re: Sk. Harun & Ors.

... ... Petitioners.

Mr. Somnath Chakraborty ... for the petitioners.

Mr. Swapan Banerjee, Ms. Purnima Ghosh ... ... for the State.

Having considered the materials on record and bearing in mind the nature of allegations in the alleged crime and in view of the exonerative nature of statement of the victim recorded under Section 164 of the Code of Criminal Procedure, we are inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioners be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. Petitioners shall appear before the investigating officer and hand over their passport, if any, within a period of four weeks from date. In the event the petitioners do not have passports, they shall personally appear before the 2 investigating officer and furnish affidavits to that effect within the time frame mentioned herein above.

The application for anticipatory bail is, thus, disposed of. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
