                                                         ORDER

This writ petition has been filed for direction to the respondents to disburse all petitioner’s retirement benefits including 1/4 https://www.mhc.tn.gov.in/judis ( Uploaded on: 22/01/2026 06:03:34 pm ) W.P.No.43655 of 2025 gratuity by considering petitioner’s representation dated 09.08.2024.

2. The petitioner was appointed as Workman on daily basis in Dharmapuri District Milk Producers Cooperative Union. Thereafter, he was appointed as Junior Musthoor . While being so, enquiry was conducted under Section 81 of the Tamilnadu Cooperative Societies Act and it was found that Rs.1,24,24,940/- was misappropriated by Manager(Dairing), Manager (Engg) of the Society. However, there was no surcharge proceedings against the petitioner. But FIR has been registered as against the petitioner and now final report has been filed and he is facing criminal proceedings for the offence punishable under Section 120(B), 408, 465, 466, 468, 471, 477 and 477(A) of IPC in CC.Nos.261 of 2021 and 262 of 2022 on the file of the District Court, Dharmapuri. That apart, the petitioner has also been served with charge memo and he is facing disciplinary proceedings. He was permitted to retire as on 30.06.2024 on attaining the age of superannuation subject to condition of 1997-1988, 1998-1999 FAM audit Special Report defects 81 enquiry and CCIW case pending at District Court, Dharmapuri.

Therefore, the request made by the petitioner seeking retirement benefits on his retirement cannot be considered.

3. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
