Heard learned counsel for the petitioner, Sri Pawan Kumar Misra, holding brief of Sri Pranjal Mehrotra has filed Vakalatnama on behalf of respondent no. 1 in the Court today, which is kept on record. Learned Standing Counsel has accepted notice on behalf of respondent no. 2.
It is contended by learned counsel for the petitioner that his Khasra No. 47 area 0.0037 hectare situate in village Kashi Tehsil and District Meerut hereinafter referred to as the disputed plot was acquired on 14.9.2016. It is next contended that petitioner had purchased the said plot from the recorded tenure holder after paying a sale consideration of Rs. 23,16,000/- by registered sale dated dated 9.10.2015, annexure-2 to the writ petition. He further contended that although award has been made on 7.6.2017, annexure no. 3 to the writ petition in respect to the disputed plot but the amount of compensation which the petitioner is entitled to receive on account of his having purchased the disputed plot from the recorded tenure holder has not been paid to him although in this regard he has made representation on 31.5.2019, copy whereof has been brought on record on as Annexure- 4 to the writ petition but the said representation of the petitioner has not been decided till date.
Learned counsel for the petitioner made a prayer to direct the respondent no.2 to decide the petitioner's representation within a specified period to which learned Standing Counsel and Sri Pawan Kumar Misra holding brief of Sri Pranjal Mehrotra, learned counsel for the respondents have no objection.
Having heard learned counsel for the parties, without expressing any opinion on merits, we dispose of this petition with the liberty to the petitioner to file a fresh comprehensive representation ventilating all his grievances along with certified copy of this order before respondent no. 2 within a period of three weeks from today. In case any such representation is filed by the petitioner within the time so allowed, the respondent no. 2 will consider and decide the same in accordance with law by a speaking and reasoned order after affording opportunity of hearing to all concerned as expeditiously as possible, preferably within a period of three months from the date of filing of such a representation by the petitioner before him.
