 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT
                               JODHPUR.
                                    :::
                                 ORDER

S.B. Civil Writ Petition No.9044/2014 Shispal & Ors.

Vs. Rajasthan State Road Transport Corp. & Ors.

Date of Order :: 15.12.2014 HON'BLE MR. JUSTICE SANDEEP MEHTA Mr.Mukesh Vyas, for the petitioners. Mr.PR Singh, AAG a/w Mr.Dinesh Ojha, for the respondents.

....

Mr.P.R. Singh, learned Addl. Advocate General accepts notice for the respondents, hence, service is complete.

Learned counsel for the petitioners submits that the controversy involved in the instant writ petition is covered by the judgment dated 18.1.2013 rendered by this Court in S.B. Civil Writ Petition No.4183/2012 (Yakub Khan. vs. The State of Raj. & Anr.).

Though learned Addl. Advocate General concedes that the controversy is similar to the one referred to above, despite that, he contends that the petitioners' grievance can S.B. Civil Writ Petition No.9044/2014 Shispal & Ors. Vs. Rajasthan State Road Transport Corp. & Ors. 2 be redressed by directing them to submit a representation which can be considered by the respondents in the light of the aforesaid judgment.

In the opinion of this Court, no useful purpose would be served by directing the petitioners to submit a representation to the respondents and invite further litigation and thus, the instant writ petition is disposed of in the terms as set out in the order dated 18.1.2013 passed by this Court in Yakub Khan's case (supra). For the sake of convenience, the relevant portion of the aforesaid order dated 18.1.2013 is reproduced herein below :-

"After considering the entire facts and circumstances of the case, this writ petition is disposed of with direction to the respondents to pay all the dues to the petitioner who has retired from the services, within a period of three months from today.
It is made clear that if the payment will not be paid within three months, the petitioner will be entitled to interest @ 6% per annum."

No order as to cost.
