(1)Any Prohibition Officer empowered to investigate an offence under this Act shall have power to grant bail in accordance with the provisions of [the Code of Criminal Procedure, 1973 (2 of 1974)] [Substituted 'the Code of Criminal Procedure, 1898 (V of 1898)' by Gujarat Act No. 9 of 2017, dated 16.3.2017.] to any person arrested without a warrant for an offence under this Act.(2)When any person has been arrested under Section 126, a Prohibition Officer empowered to investigate offence under this Act shall have power to grant bail in accordance with the provisions of [the Code of Criminal Procedure, 1973 (2 of 1974)] [Substituted 'the Code of Criminal Procedure, 1898 (V of 1898)' by Gujarat Act No. 9 of 2017, dated 16.3.2017.].
