Heard learned counsel for the petitioners and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 353, 379, 189, 504, 506 of the Indian Penal Code and Section 135 of the Electricity Act.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. Patna High Court CR. MISC. No.38798 of 2022(2) dt.06-12-2022 2/3 The informant, Junior Electrical Engineer, alleges that on 24.02.2022, at about 05.20 p.m., on account of revenue collection and electricity disconnection work, a search was conducted along with other staff at village Sadha Khemaji. It is further alleged that consumer Prakash Kumar, Deepak Kumar and Umrawati Devi were having outstanding electricity bill as detailed in the FIR and they were instructed to deposit the outstanding bill in the revenue collection office to which they refused. Thereafter, from the same premises three other electricity connections were disconnected on the basis of their outstanding bill as detailed in the FIR. It is further alleged that after the said disconnection three named accused petitioners along with three unknown persons with an intention to kill assaulted the informant and his team and tried to destroy the government documents and forcefully get the connection of electricity restored thus causing loss of Rs.4,60,033/- to NBPDCL. It is further alleged that petitioners no. 1 and 2 assaulted and threatened and petitioner no. 2 also assaulted Dharmveer Kumar Manavbal with lathi when he tired to cut his electricity connection.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is Patna High Court CR. MISC. No.38798 of 2022(2) dt.06-12-2022 3/3 further submitted that no electricity bill was outstanding against their meter which amply demonstrates that the informant even without verifying the fact in its correct perspective has instituted the present FIR.

Learned counsel appearing for the Company opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Special Case No. 623 of 2022 arising out of Mufassil Sadar P.S. Case No. 153 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
