... for the defendant The Court : The suit is for eviction and for mesne profit. The suit was decreed by a judgement and decree dated June 15, 2009. On appeal the decree was set aside in part. The Appeal Court remanded the suit to the first Court for determination of mesne profit after appointing a Special Referee for such purpose by its judgement and decree dated October 4, 2010.
A Special Leave Petition was filed. The Hon'ble Supreme Court directed that the Special Referee appointed by the Hon'ble Division Bench for the purpose of computing the mesne profit to 2 submit his report to the Hon'ble Supreme Court. The Special Referee had computed the mesne profit and submitted his report to the Hon'ble Supreme Court. The Special Leave Petition in which such report has been submitted by the Special Referee is pending consideration before the Hon'ble Supreme Court of India. The Special Leave Petition is scheduled to be taken up for hearing on January 20, 2015.
In such circumstances, C.S. No. 530 of 1992 is directed to go out of list with liberty to the parties to mention upon disposal of the Special Leave Petition pending before the Hon'ble Supreme Court of India.
