3. By virtue of the present appeal under Section 415(2) read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the appellant seeks to challenge the judgment dated 15.12.2025 and order on sentence 05.01.2026 passed by learned ASJ (FTSC) (POCSO)-01, South-West District, Dwarka Courts, Delhi (learned Trial Court) in SC No.110/2023 arising out of FIR No.751/2022 registered at PS.: Uttam Nagar under Sections 506/174A of the Indian Penal Code, 1860 (IPC) and Section 6 read with Sections 5(m) & (n) and Section 10 of the Protection of Children from This is a digitally signed order.

Vide the order on sentence dated 05.01.2026, the appellant was sentenced to undergo rigorous imprisonment of twenty years with fine of Rs.10,000/- under Section 6 of the POCSO; rigorous imprisonment of five years with fine of Rs.5,000/- under Section 10 of the POCSO; rigorous imprisonment of six months with fine of Rs.2,000/- under Section 174A of the IPC; and rigorous imprisonment of one year under Section 506 of the IPC. In default of payment of fine, to undergo sentence of one month each for the offences under Section 6 and Section 10 of the POCSO; and sentence of fifteen days for the offence under Section 174 of the IPC.

4. Issue notice. Learned APP appearing for the State accepts notice.

5. For the reasons stated therein, Admit.

6. Let TCR be requisitioned in the digitised form from the learned Trial Court within a period of four weeks.

7. List this appeal in due course in the category of 'Regulars' as per the year of its seniority.

CRL.M.(BAIL) 548/2026 (Suspension of sentence)

8. By virtue of the present application under Section 430 of the BNSS, the appellant seeks suspension of sentence imposed vide order dated 05.01.2026 during the pendency of the present appeal.

9. Issue notice. Learned APP for the State seeks, and is granted, a period of four weeks for filing the Status Report along with SCRB Report, if needed.

10. Keeping in view the nature of the facts and disputes involved, the parties are hereby called upon to file their respective written synopsis instead of reply/ rejoinder not exceeding three pages, giving a chronological This is a digitally signed order.

It is clarified that it is not compulsory for the complainant/ prosecutrix/ informant to appear in person for the hearing.
