Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the third respondent by demolishing the existing dilapidated Fish Market at Mettu Street, Chengalpattu Town and to construct new Modern fish market with parking area, shops with tiled walls and mosaic floor, pucca drainage facility with pipeline for each shop to flush out water and fish wastes, electric light for each shop along with good drinking water facility, toilets and bathrooms for trader's use in the government land in Survey No.409 or any other land in the same area.

The petitioner has come up with this writ petition seeking for a Writ of Mandamus to direct the third respondent to demolish the existing dilapidated fish Market at Mettu Street, Chengalpet Town and to construct new modern fish market with parking area, shops with tiled walls and mosaic floor, pucca drainage facility with pipeline for each shop to flush out water and fish wastes, electric light for each shop along with good drinking water facility, toilets and bathrooms for trader's use in the government land in Survey No.409 or any other land in the same area.
2. Heard the learned counsel for the petitioner, the learned Special Government Pleader appearing for the respondents 1 and 2 and the learned standing counsel for the Municipality / 3rd respondent.
3. The grievance of the petitioner-Sangam is that the market constructed for selling fish is in a dilapidated condition. Despite representation, the third respondent did not take any action and in the meanwhile they have floated tender for sale of fish in the market.
4. The learned standing counsel for the Municipality / third respondent submitted that the market is being conducted in a open place and the third respondent is ready to take appropriate action based on the representation of the petitioner dated 03.01.2018.
5. In the light of the facts and submission, this Court, without going into the merits of the case, directs the third respondent to take appropriate action on the representation of the petitioner dated 03.01.2018, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.
6.With the above observation and direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
