      Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue an appropriate wrif. bfcler or direction, more particularly one
in the nature of Writ of Mandamus; declaring the action of the 3'"* and 4*^
 respondents     in     seizing    the   retail put-let of Bio-Diesel        situated      at     P-

Rayalavaram       Village,       Prathipadu       Mandal,    Kakinada   District,        without

contravention     of    registration    certificate guidelines,     without     serving         the
mediation report, and without any malpractice of the petitioner, while doing the
business, is highly illegal, arbitrary, unconstitutional and violation of Articles 14
and 19 (1) (g) of the Constitution of India and consequently                      direct the

respondents No.2 to 4 allow the petitioner to run the Bio-Diesel Out-let by de-
sealing the out-let premises in the interest of justice.

situated at Dharmavaram village, Pratipadu Mandal, Kakinada District by
Restraining the respondents from intertering with the peaceful running of the
petitioner's business. Pending disposal Bf WP No.549 of 2026, on the file of
ihe High Court.                               - ^     .

        The petition coming on for hearing, upon perusing the Petition and the
Affidavit filed in support thereof and; upon hearing the arguments of Sri V V N
Narayana Rao, Advocate for the Petitiorier, and of GP for Civil Supplies for the
Respondents, the Court made the fQilowitig.
   ORDER

Learned counsel for the petitioner submitted that the authorities without following the procedure contemplated under law and without serving mediators' report and without issuing any show cause even notice to let the petitioner know the contraventions, if any, committed by him, seized the unblended Bio-Diesel out let of the petitioner. He would further contend that for extraneous reasons only the out let of the petitioner was seized even though the petitioner had never contravened any of the provisions of the certificate and the authorities can not be permitted to act as per their whims. Accordingly, prayed to direct the authorities to de-seal the out-let.

Learned Assistant Government Pleader submitted that the petitioner had contravened the provisions of the certificate conditions, the authorities have rightly seized the out-let of the petitioner and no Indulgence need to be shown.

In view of the submissions made by the learned counsel for the petitioner that the unblended BioDiesel out let of the petitioner was sealed without giving him any notice letting him know the contraventions, if any, he committed and without supplying copy of the mediators' report, this court prima facie finds a point to be considered In this writ petition and therefore, there shall be an interim direction as follows:

"the respondent authorities are directed to de-seal the Bio-Diesel out-let premises and permit the petitioner to run the unit, until further orders."

Post the matter on 16.02.2026.

In the meantime, reply, if any, by the petitioner.
