Section 36(1) in The Jammu and Kashmir, Registration of Tourist Trade Act, 1978
(1)Save as otherwise provided in sub-section (2) no prosecution shall be instituted against any person for any offence under this Act, except on a complaint made by the prescribed authority or a Police Officer, not below the rank of Sub-Inspector.
