05/ 21.01.2015The petitioner is an accused in a case registered under Sections 370/371/120B/376 of the Indian Penal Code, Section 23/26 of the Juvenile Justice Act, Sections 4/8/12 of the POSCO Act and under Sections 14 and 16 of the Bounded Labour Act.
It is alleged against the petitioner in the F.I.R. that he abducted Sanjeeta Kumari (sister of the informant) and sold her to someone at somewhere. During investigation, the victim girl had been recovered and her statement was recorded under Section 164 Cr.P.C. in which she has falsified the contention made by the informant in the written report. The petitioner is the brother-in-law of victim.
It is submitted that the petitioner is in custody for more than three months.
Counsel for the State has opposed the prayer.
Considering the statement of victim recorded under Section 164 Cr.P.C., the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Ten thousand) with two sureties of like amount each to the satisfaction of the Chief Judicial Magistrate, Gumla in connection with AHTU- Gumla P.S. Case No. 15 of 2014, corresponding to G.R.No.694/2014.
