Madhya Pradesh High Court

Mathura Prasad Ahirwar vs The State Of Madhya Pradesh on 2 May, 2017

      WP-00029-2016& Conc.1285/2015, Conc.1290/2016

02-05-2017

Shri K.C. Ghildiyal, learned counsel and Shri V.D.S.
Chouhan, learned counsel for the petitioners in their respective
petitions.
Shri Sanjay Dwivedi, learned Dy.AG for the
respondents/State.

Counsel for the petitioner contend that the order dated 11.02.2016 has not been complied with.

On the other hand, learned Dy.AG for the respondents/State submits that they have filed a Writ Appeal No.539/2016 against the said order, which was decided on 21.10.2016 with direction to pay an amount of Rs.2500/- of block grant to the institution. However, the petitioners are entitled to receive this amount. Against this order Review Petition No. 80/2017 has also been filed by the State Government.

It is the grievance of the petitioners that if they want to pay the amount to the institution as directed by the Division Bench of this Court they have to implement the said order, but, counsel for the respondents submits that the review petition is pending, therefore, hearing of the matter may be deferred including the compliance of the orders as it is relating to payment of the salary and the order dated 11.02.2016 has not been complied with along with the order dated 21.10.2016 passed by the Division Bench on account of the pendency of the review petition which is reported to be pending in defect. It is to observe here that the State Government shall take appropriate step to rectify the defect and seek an order of stay within a period of three months from the Division Bench in the review petition, otherwise, they ought to comply the order dated 11.02.2016 and modified by the Division Bench on 21.10.2016.

List in the second week of August-2017.

(J.K. MAHESHWARI) JUDGE Raju
